Official Rules 2016

No Purchase Necessary To Enter Or Win. A Purchase Of Any Kind Will Not Increase Your Chances Of Winning.  Void Where Prohibited.

1. Contest Period: The Delta Vacations – Grenada Tourism Authority Social Media Contest (the “Contest”) begins at 10:00:00 am Eastern Time (“ET”) on 12/5/16 and ends at 10:00:00 am ET on 12/19/16 (the “Contest Period”).
   
   
2. Eligibility: The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia (the “Eligible Jurisdictions”), who are eighteen (18) years of age and older as of the date of their entry. Employees, officers and directors of, Delta Vacations (“Sponsor”) and any of Sponsors’ respective affiliates, dealers, parents, subsidiary companies, and advertising and promotion agencies (collectively the “Contest Entities”) and members of their immediate families (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside), and/or those living in the same household of each (whether or not related thereto) are not eligible to enter or win the prize herein. Void outside the Eligible Jurisdictions or where otherwise prohibited or restricted by law. Contest is subject to all country, federal, state, local, and municipal laws. By entering the Contest, participants are bound by and agree to these Official Rules, and the decisions of the Sponsor, which are final and binding.
   
   
3. How to Enter: Throughout the Contest Period, eligible participants must post or tag their best photo that represents what vacation means to you on Facebook using the Contest hashtag #GrenadaContest and tell us in one sentence what vacation means to you. Photo must be set to Public and will be judged on creativity and overall composition. Only one entry per person is allowed. Promotional Entities are not responsible for lost, late, illegible, or incomplete entries. All Entries become the property of the Sponsor and may be used for promotional purposes.

1. A contest entry must meet the requirements below:

1. Must not contain material that violates or infringes another’s rights, including, but not limited to, privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
2. Must not disparage Sponsor;
3. Must not include sensitive personally identifiable information;
4. Must not contain material that is inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous (as determined by Sponsor at Sponsor’s sole discretion);
5. Must not contain, facilitate, reference or use material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, ethnicity, religion, nationality, disability, sexual orientation, political orientation, citizenship, ancestry, marital status or age (as determined by Sponsor at Sponsor’s sole discretion);
6. Must not contain any viruses, spyware, malware or other malicious components that are designed to harm the functionality of a computer in any way; and
7. Must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where posted.

2. NOTE: If any entry fails to comply with any of these requirements or any other provisions of these Official Rules, Sponsor reserves the right to disqualify the entry or the entrant, at its sole discretion.

4. Grand Prize Selection: On December 19, 2016 at 2 pm EST, a Delta Vacations representative will choose the winner (the “Grand Prize Selection”) for one (1) grand prize will be performed, from among all eligible Entries received throughout the Contest Period. Sponsor will conduct the Grand Prize Selection. The decisions of Sponsor are final and binding on all matters relating to this Contest. Odds of winning the Grand Prize are dependent upon the total number of Entries received throughout the entire Contest Period.
   
   
5. Grand Prize and Approximate Retail Value (“ARV”): One (1) Grand Prize is available to be awarded in this Contest. The Grand Prize winner, once confirmed as detailed below, will receive a trip certificate, for the Grand Prize winner and one (1) guest, to Grenada. The Grand Prize package trip certificate is valid for:  (a) round-trip Main Cabin air transportation valued at up to $700 per ticket (terms and conditions apply, see section 6 below) for the Grand Prize winner and one (1) guest from a major U.S. airport serviced by Delta Air Lines near to the Grand Prize winner’s home (as determined by Sponsor), to a major airport serviced by Delta Air Lines in available destinations (as determined by Sponsor) and (b) hotel accommodations for 7 nights at Mount Cinnamon Resort & Beach Club (terms and conditions apply, see section 6 below) valued up to a total of $5,100.00. The ARV of the Grand Prize is sixty-five hundred U.S. dollars ($6,500.00). If any component of the trip, air or land, exceeds the value specified on the certificate, recipient is responsible for any balance due and must be paid in full at time of booking. 6. Grand Prize Conditions: All Grand Prize details, including but not limited to trip dates, are at Sponsor’s sole discretion, however, Sponsor will make best efforts to accommodate Grand Prize winner and guest’s preferred dates. Grand Prize trip must be booked by 12/19/17 and travel must be completed by 12/31/17.  Sponsor reserves the right to substitute a Grand Prize (or a portion thereof) with another prize of greater or comparable value. It is the responsibility of the Grand Prize winner and their guest to be in possession of all necessary travel documentation (e.g., Photo ID, valid passport, Credit Card) at the time and place of departure, or prize may be forfeited. Actual value of the Grand Prize depends on any fluctuations in current market conditions at time of prize fulfillment, and the location of winner’s residence. Any difference between the stated ARV and the actual value, if any, will not be awarded. Trip is subject to air/hotel availability, the vagaries of flight variation, work stoppages, schedule or route changes, holiday and blackout dates, and any other travel conditions/restrictions that may apply. All other expenses relating to acceptance of the Grand Prize not explicitly stated herein, including but not limited to, taxes, meals, ground transportation to/from the airport near Grand Prize winners home, beverages and gratuities, are solely the responsibility of the Grand Prize winner. Complete terms and conditions of Grand Prize trip will be furnished with prize notification and/or further correspondence. Sponsor reserves the right to structure the travel route in their sole discretion. Grand Prize trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Contest Entities will not replace any lost or stolen tickets, travel vouchers, or certificates. Once travel has been confirmed, no changes may be made. Contest Entities are not responsible for any expenses that may be incurred as a consequence of a transportation cancellation/delay. Grand Prize is non-transferable and no substitutions or cash awards are allowed, except at the discretion of the Sponsor, in which case a prize of equal or greater value will be awarded. Sponsor will furnish an Internal Revenue Service Form 1099 to the Grand Prize winner for the actual retail value of the Grand Prize for the tax year in which Grand Prize is accepted. The Contest Entities shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carriers, tour operators, hotels or other transportation companies or any other persons providing any of these services and accommodations including any results thereof such as changes in services or accommodations necessitated by same. If any portion of a trip prize is unable to take place as planned, for any reason, including but not limited to, cancellation, scheduling conflicts or an event of force majeure, that portion of the prize will be forfeited, the remaining components of the Grand Prize will be awarded and Sponsor’s obligation to the winner will be deemed fulfilled, and no other additional compensation will be provided. If Grand Prize winner can not find a guest to travel with them, such portion of the prize will be forfeited and no substitution or compensation shall be owed by Contest Entities.
   
   The following are Delta Vacations’ Terms and Conditions. Tickets and certificates are non-refundable and non-transferable. Tickets and certificates issued in conjunction with this promotion have zero cash value. Delta Vacations will provide air transportation via Delta Air Lines from any city in the U.S. 50 or Canada (excluding Quebec). Travel is permitted on designated flights operated by Delta Air Lines; the Delta Connection® carriers: Compass Airlines, ExpressJet Airlines, Inc., GoJet Airlines, Endeavor Air, Shuttle America, and SkyWest; Delta Shuttle® carriers: Shuttle America and Compass Airlines. Travel via other DL Airlink and DL designated affiliated partner flights is not permitted. The recipient shall be responsible for travel to and from the airport served by such flights. Travel is not permitted on the following dates: 2016 - January 1, March 26- April 17, Nov 19-23, Dec 17-31.; 2017- January 1-2, March 19-April 17, August 1-15, November 19-23, December 17-28. Not valid with previously purchased trip. Trip certificate may not be combined with any other coupon, certificates, discount, bonus, infant fare, upgrade, SkyMiles Air Travel Award or promotional offers/tickets. Trip certificate is not valid with Miscellaneous Charge Orders or Prepaid tickets. Trip certificate is not applicable to Ski; Dive; Globus family of brands including Globus, Cosmos, Monograms and Avalon. Trip certificate is non-transferable. Positive identification will be required at time of check-in. Purchased certificates are subject to confiscation and you will not be allowed to travel. Only original certificates will be accepted. Certificates will not be replaced. Void if altered. Travel must be roundtrip.
   
   Reservations must be made and ticket issued prior to departure. Booking and travel dates must fall into the range as specified. Delta Vacations must make all reservations and issue all travel documentation. Certificate may only be applied towards number of passengers specified on the certificate; passengers must travel on the same itinerary and must be booked through Delta Vacations. Any unused portion of the certificate will not be refunded, and cannot be used towards another booking or another service component. Travel agent commission is not paid/earned on a free trip value, taxes, and fees. If any component of the trip, air or land, exceeds the value specified on the certificate, recipient is responsible for any balance due and must be paid in full at time of booking. Hotel taxes, state and federal income taxes may apply and are the sole responsibility of the recipient. Checked luggage fees may apply and are the sole responsibility of the recipient. Fees are charged each way, and are subject to change. Refer to delta.com for current rates. Changes to reservations, once made, are not permitted. A per ticket surcharge will apply for paper tickets issued in markets where electronic ticketing is available. Substitutions will not be allowed. Space is subject to availability. Winner must be 18 years of age or older. SkyMiles mileage credit and/or MQDs may or may not be awarded. Flight schedules are subject to change without notice. Delta Vacations is the final authority on the interpretation of these rules and reserve the right to change these terms and conditions without prior notice. Standard Delta Vacations Terms and Conditions apply, and are outlined during the booking process; other airline, hotel, or vendor restrictions may apply. Delta Vacations is managed, operated, and marketed by MLT Vacations, LLC. Certain destinations may charge taxes or fees not covered by this certificate or Delta Vacations.

7. Notification/Acceptance: The potential Grand Prize winner must comply with these Official Rules as published in order to accept the Grand Prize and be confirmed as the official Grand Prize winner. Sponsor will notify the potential Grand Prize winner on Facebook by commenting on the winning photo immediately after the Grand Prize Selection on December 19, 2016. Upon notification or notification attempt, the potential Grand Prize winner will be required to respond to such notification attempt and execute and return an affidavit of acceptance, eligibility, liability and publicity release, as well as a W-9, within two (2) days of such notification or notification attempt (or less if specified by Sponsor upon notification or in the release documents, due to exigencies). Sponsor will attempt to contact the potential Grand Prize winner two (2) times during the two (2) day period. If notification attempt(s) fail for any reason, or if the potential Grand Prize winner does not comply with these Official Rules, such prize may be forfeited, at Sponsor’s discretion.
   
   
8. General Rules: By entering the Contest, entrants agree to be bound by these Official Rules and the decisions of the Contest Entities, which shall be final and binding in all respects. Entries will be declared by the authorized account holder of the username at the time of Facebook posting. In the event of a dispute over the identity of a selected potential winner, the natural person who is the authorized account holder of the Facebook username used to submit the entry will be declared the potential prize winner. If any portion of these rules is deemed illegal, such portion will be replaced with a legal clause that most closely resembles Sponsor’s intent.
   
   
9. Limitations of Liability: Entrants, by participating in the Contest, release and agree to hold the Contest Entities harmless from and against any and all liability, claims or actions of any kind whatsoever for any injuries, losses or damages of any kind to persons, including death and bodily injury, and property, arising in whole or in part, directly or indirectly, from participating in this Contest in any manner, including but not limited to, acceptance, possession, use or misuse of the prize, or in any Contest-related activity, whether sponsored, held by, or paid for by a third party or by Sponsor and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Each entrant, as well as the Grand Prize winner and their guest, agrees to indemnify the Contest Entities from any and all liability resulting or arising from the Contest and hereby acknowledges that Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to a prize herein. Additionally, the Contest Entities are not responsible for late, lost, stolen, incomplete, misdirected, garbled, damaged, delayed or undelivered entries;, for any incorrect or inaccurate information, whether caused by interference, tampering, manipulation, weather or natural disaster, acts of war. Contest Entities are not responsible for other errors or difficulties of any kind whether human, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of Entries, the notification of the potential Grand Prize winner(s), or in any Contest-related materials. Sponsor reserves the right, at its sole discretion, to disqualify any individual it suspects of tampering with the entry process or the operation of the Contest, to be acting in violation of the Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any person or entity. If, for any reason, the Contest is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, unauthorized human intervention or any other causes which Sponsor, in its sole opinion, deems could corrupt, manipulate or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and post notice of the action where they see fit. If Sponsor terminates the Contest prior to the end of the Contest Period, Sponsor will select the potential Grand Prize winner in random drawing from among all valid, non-suspect, eligible Entries received prior to termination, if any, or as otherwise may be deemed fair and equitable by Sponsor. In no event will more than the stated number of prizes be awarded.
   
   
10. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL THE CONTEST ENTITIES BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO THE INDIVIDUAL ENTRANT IN THIS CONTEST. SPONSOR’S FAILURE TO ENFORCE ANY PROVISION IN THESE OFFICIAL RULES WILL NOT BE DEEMED A WAIVER OF SUCH.
    
    
11. Disputes, Governing Law and Venue: ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO PRINCIPLES OF CONFLICTS OF LAW; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, IF ANY, BUT IN NO EVENT WILL ENTRANT BE ENTITLED TO RECEIVE ATTORNEYS’ FEES OR BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
    
    
12. Privacy Policy: Any personally identifiable information collected during this Contest will be collected by Sponsor, or their affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules and in accordance with Sponsor's Privacy Policy as stated at http://www.deltavacations.com/misc/privacypolicy.do.
    
    
13. Grant of Rights: Once confirmed as the Grand Prize winner, the Contest Entities may use, display, distribute or publish such Grand Prize winner’s name, likeness, photograph, voice, address (city and state), biographical information, statements, and any material based thereon or derived there from, or to refrain from so doing, in any manner in any and all media, whether now known or hereafter devised, anywhere in the world in perpetuity in connection with this Contest, or as Contest Entities otherwise determine, in their sole discretion, and for purposes of advertising in trade or promoting/publicizing Sponsor and their products and/or services, without compensation (where legal). Acceptance of a prize constitutes a waiver of any claims to compensation, royalties, or other remuneration for such use.
    
    
14. Winners’ List: For the name of the Grand Prize winner, available after the Contest Period has ended, send a stamped, self-addressed envelope, to be received by 12/31/16, to Delta Vacations – Grenada Tourism Authority Social Media Contest Winner List, Attn: Nicole Anderson, 700 South Central Avenue, Atlanta, GA 30354.
